Texas is making sure everyone remembers that wishing someone “Merry Christmas” is now protected by law in its public schools — and conservatives are hoping similar measures will gain momentum across America.
Garnering national attention when it was approved by the Texas Legislature this past summer, the bipartisan law removes legal risks from exchanging holiday greetings in classrooms. It also protects symbols such as Christmas trees, menorahs or nativity scenes, as long as more than one religion is represented and a secular symbol such as a snowman is displayed.
The law’s sponsor, Houston Republican Dwayne Bohac (BOH’-hak), said the law is meant to codify the religious freedoms of the First Amendment and keep “censorship of Christmas out of public schools.”
One of its co-sponsors, Laredo Democrat Richard Raymond, said “Christmas and Hanukkah obviously do have religious implications for so many” but they’re “just part of America.”

OBAMACARE PRIVACY? California exchange shared data without permission
The California health exchange has admitted it has been divulging contact information for tens of thousands of consumers to insurance agents without their permission or knowledge in an effort to hit deadlines for coverage.
The consumers in question had gone online to research insurance options, but didn’t ask to be contacted. Social Security numbers, income and other information were not provided to the agents, but names, addresses, phone numbers and email addresses were made available, exchange officials said.
The names provided by Covered California include people who started an insurance application on the website but didn’t complete the process.
State officials say they do not know exactly how many people are affected by the information sharing.
Some insurance brokers and consumers were unhappy with the initiative, despite assurances that it met privacy laws.
“I’m shocked and dumbfounded,” said Sam Smith, an Encino insurance broker and president of the California Association of Health Underwriters, an industry group.
“These people would have a legitimate complaint,” said Smith, who added he had been given two consumer names.
A local agent emailed Robert Blatt on Thursday asking him about the application he’d started.
“You can’t do this,” Blatt, a technology consultant in Ventura County, told the newspaper. “For a government agency to release this information to an outside person is a major issue.”

Today the first female White House press secretary suggested that MSNBC should fire host Martin Bashir for suggesting that someone defecate and/or urinate in former Alaska Governor Sarah Palin’s mouth.
Dee Dee Myers, who was Bill Clinton’s campaign spokeswoman and his first White House press secretary, said she could not imagine where “such thoughts even come from” and tweeted “#Gottago” while linking to an article in which MSNBC was mum about whether Bashir’s apology was enough.

Myers, who has written a book about why women leaders should rule the world, spoke out after Breitbart News reported that feminist and women’s groups had been silent on Bashir’s remarks. Talk radio host Mark Levin suggested women’s groups were silent because Palin is not a left-wing politician.
After Bashir apologized on his show on Monday for words that he admitted were “wholly inappropriate” and “offensive,” Breitbart News exclusively obtained a letter from Palin’s PAC, SarahPAC, that asked MSNBC President Phil Griffin and NBC News President Deborah Turness what action the network would take against Bashir for his “appalling” words. It also mentions that MSNBC has set a precedent of firing and disciplining other anchors for “offensive language.”
“You fired Don Imus for offensive language in describing the Rutgers University Women’s Basketball team, you suspended Alec Baldwin, and yet nothing has happened to Mr. Bashir,” the letter reads. “Are we to assume then, that disciplinary procedures at your network take place based on the target of the remarks rather than the remarks themselves?”
The letter also mentions that MSNBC suspended Baldwin’s show for two weeks after he made anti-gay remarks on the streets of New York off the air, while “Mr. Bashir’s violent rhetoric” was displayed on the air.
The letter concludes by saying, “Americans deserve to know that your network doesn’t condone violent and hateful rhetoric directed at anyone, regardless of gender, sexual orientation, or political persuasion.”

A Mexican national who entered the U.S. illegally to kill a U.S. Border Patrol agent has been given a hefty sentence after prosecution by the U.S. Attorney’s Office.
Marcos Rodriguez-Perez was previously given “supervised release” by U.S. authorities for illegally smuggling human beings into the US. While on supervised release, the illegal alien participated in the 2009 killing of U.S. Border Patrol Agent Robert Rosas, Jr., along with three other Mexican nationals who had also entered the U.S. illegally or otherwise played a role in the killing. The four admittedly took advantage of the unsecured U.S./Mexico border and lured, trapped, and murdered the young Border Patrol agent for the purpose of stealing his night-vision goggles.
Rodriguez-Perez will serve 56 years in a U.S. prison cell for his participation in the crime. He pleaded guilty to “conspiracy to commit robbery and kidnapping, robbery of personal property of the United States, and use and carrying of a firearm during the commission of a crime of violence,” according to the U.S. Attorney’s Office.
In a Breitbart news exclusive, National Border Patrol Council Vice President Shawn Moran stated: “The fact that this killer was on supervised release for alien smuggling compounds this tragedy. We need to take alien smuggling and immigration crimes seriously. This case belies the commonly held notion that illegal aliens are good people just coming to the US to look for work.”
Moran also honored Border Patrol Agent Rosas and stated: “Robert Rosas is what every Border Patrol agent should aspire to be. A hard worker, a loving husband, and devoted father.” He added: “He served the nation he loved and fought with tenacity until his final moment. The death of Border Patrol Agent Rosas and the circumstances surrounding the ordeal have highlighted a number of recent issues facing the men and women of the U.S. Border Patrol. In Lone Survivor, Wahlberg portrays the struggles Navy SEAL Marcus Luttrell endured when he alone survived an ambush attack in Afghanistan in 2005.
Wahlberg held nothing back during a question and answer session with other actors at the film’s Nov. 12 premiere. He said his movie The Fighter required “four and a half years” of training, and “it really means nothing” compared to what Navy SEALS endure.

Three people in Virginia, including a DMV employee, pleaded guilty this week to conspiring to get state IDs or driver’s licenses for at least 300 illegal immigrants.
Noemi Barboza pleaded guilty on Thursday to “a bribery conspiracy charge, admitting that she often drove illegal immigrants to the Fairfax DMV location where an employee would approve their applications for driver’s licenses, learner’s permits, and identification cards knowing they could not prove legal presence in the United States.” Four people engaged in the scheme from 2007 to 2011. The fourth person has not yet been charged.
The illegal immigrants paid Barboza’s husband or another person, who then reportedly “split the money with” Maria Cavallaro, a 45-year-old DMV employee. Cavallaro and Barboza’s husband, 42-year-old Jose Calderon, “pleaded guilty to their roles Wednesday, admitting they helped obtain documents for as many as 300 people and netted tens of thousands of dollars for themselves.” In Virginia, proof of legal presence in the United States is needed to get a driver’s license or a state ID.
On Thursday, Barboza said she got involved “just to help” her husband, but she “acknowledged she benefited from the cash he received.” Cavallaro’s attorney said she accepted the bribes because “she felt sorry for people.”
According to the Washington Post, Cavallaro “was fired from the DMV. Barboza faces up to five years in prison at her Feb. 14 sentencing.”

New details about what took place on the night of the Benghazi terror attack more than a year ago may come to light when witnesses who were on the ground during the assault meet with congressional lawmakers later this month.
Three CIA employees who were eyewitness to the attack are expected to testify in a closed-door session before the House Intelligence Subcommittee on Oversight and Investigations during the week of November 11, sources told Fox News on Thursday.

It’s now a matter of bipartisan consensus that President Obama should have been more honest and forthright in selling his health-care plan. Here is the transcript of the speech he never gave:
Hello, St. Paul! It is so good to be back in the great state of Minnesota. Go Gophers! [We love you!] I love you back! [Stomping, cheers.]
I don’t know if you’ve noticed, but I’ve been talking about health-care reform a little lately. [Laughter.] I want to set the record straight on a few things today.
Republicans are out there scaring folks, and saying that they’ll lose their insurance. [Boos, jeers.] No, no — hey, just because they don’t care about people doesn’t mean they are wrong about everything. [Laughter, applause.]
And they’re right about this. Some folks are going to lose their insurance. Millions of them, in fact.
Let me be clear: Just because you have insurance you like, doesn’t mean you can keep it. If it doesn’t meet the new federal standards, your plan is going to get canceled. I guarantee it.
Some of my political advisers say, “Hey, you can’t go out and tell people that, Obama. It doesn’t test well. People hate it in the polls.”
And you know what I told them? “I . . . don’t . . . care . . . about . . . the polls.” [Applause]
I said: “That’s the old politics. That’s what’s wrong with Washington, DC, right there. If you think I’m going to go out and lie about my plan, you’ve got the wrong guy. What did you think hope and change were all about?” [Laughter, applause.]
So, yeah, some of you are going to lose your insurance. Now, because of the marketplace we’ll set up, you’re going to go online and shop for new insurance. Some of you are going to get a better deal. If you don’t make much money, you’re going to get help from the government. [Cheers.]
But let me be clear again — and Axelrod hates this part [Laughter] — many of you are going to pay more than you did before. Maybe double. Because all of these new regulations cost money. You don’t believe in a free lunch, do you? [Confused murmurs.]
What we’re proposing is to get young, healthy people onto the exchanges so they can subsidize everyone else, by buying coverage they don’t want or need at a price that is higher than before. Why would they do that, you ask? [Faint laughter.] That’s what the individual mandate is all about. We’ve got to force them.
As for the doctor you like, you might not be able to keep him or her, either. [Murmurs.] If you have to change your plan, your doctor may not be in the network. And to try to keep costs down, the networks in the exchanges are really narrow. By the way, top hospitals probably aren’t going to accept a lot of plans from the exchanges, either.
Some of my friends on my side of the aisle try to minimize all this. They say that the bill has a grandfather clause. Wait until you see the regulations we write on that one — there will barely be a grandfather clause left. They say that only the 5 percent of people who get their insurance through the individual market will lose their plans. But that’s still millions of people.
Now, I can hear some of you right now saying that universal coverage is worth it. [Yeah.] But let’s be careful about that. The respected Congressional Budget Office says under my plan tens of millions of people will still be uninsured in 2020.
So that’s why I wanted to come here today, St. Paul. I wanted to tell you the hard truths. I know you can handle them. [Isolated clapping.] I know you will still support my plan, which, admittedly, is a little complicated. But we put a man on the moon! There’s no way we’re going to mess up a health-care law. Not on my watch.

On Monday, former Congressman and staunch libertarian Ron Paul (R-TX) campaigned for Virginia Republican Governor candidate Ken Cuccinelli and said Virginias would be giving up on liberty if they voted for Democrat Terry McAuliffe in Tuesday’s election and would be “insane” if they voted for so-called libertarian Robert Sarvis, the third-party candidate who may siphon enough votes from Cuccinelli to spoil the election.
Specifically referring to the mileage taxes that Sarvis indicated he may support and which may require GPS systems to be installed in everyone’s cars, Paul said “anybody who would conceivably vote for someone who would endorse a mileage tax” is “insane” because a mileage tax would be an “invasion of privacy” and would just give the government more money it could waste. In an interview on MSNBC, Sarvis indicated that he could support “vehicle-miles-driven taxes.”
Appearing with Cuccinelli, Paul also noted that Cuccinelli would cut taxes and would not support any new taxes. He said though Cuccinelli may not be in the Libertarian Party, he’s a “Constitutionalist, so he’s an ally.”
Paul also ripped Democrats for thinking that individuals are not smart to take care of themselves.
“Why should we grant this authority to a few thugs who want to take over the government to make all our decisions for us?” Paul said.
Paul said Cuccinelli is a “defender” of liberty and asked Virginians not to “give up on liberty.”
“If you elect the other guy, you are [giving up on liberty],” Paul said of McAuliffe.
Paul also said Cuccinelli has already proven that he is able to take on the federal government and called Obamacare a “monster” that Cuccinelli has fought from the beginning.
Earlier, Cuccinelli mentioned how much of an infringement Obamacare was on the liberty of Virginians and detailed his strong defense of property rights. Cuccinelli said that McAuliffe sleeps in Virginia but is of Washington and asked Virginians to say “‘No’ to Obamacare and ‘Yes’ to Liberty” by voting for Cuccinelli.

The Department of Homeland Security is quietly considering lifting a long-standing ban on Libyans coming to the U.S. for training in the aviation and nuclear fields, according to an internal document, raising red flags for lawmakers who say Libya is still a security threat.
“Now, more than ever, we have concerns about terrorist activity in that country,” Rep. Jason Chaffetz, R-Utah, told FoxNews.com. “Now the administration wants to normalize — that’s just not acceptable.”
Chaffetz and House Judiciary Committee Chairman Bob Goodlatte, R-Va., first drew attention to the draft document, which is circulating inside DHS and is not yet final. It comes a little more than a year after the Sept. 11, 2012, attack on the U.S. compound in Benghazi in which four Americans were killed. The suspects still have not been brought to justice, and Fox News has reported over the past week how several Al Qaeda-tied individuals are linked to the attack.
U.S. forces just this month captured terrorist Abu Anas al-Libi, wanted in connection with the 1998 U.S. Embassy bombings in Kenya and Tanzania, in Tripoli.
“It is shocking that the Obama administration is turning a blind eye to real terrorist threats that exist in Libya today,” Goodlatte said in a written statement. “We still haven’t gotten to the bottom of the Benghazi terrorist attacks and continue to face additional terrorist threats from Libya, yet the Obama administration is preparing to lift a longstanding ban that protects Americans and our interests.”
The DHS document calls for rescinding restrictions first put in place in 1983 that barred Libyan nationals from coming to the U.S. to study or train in aviation maintenance, flight operations or nuclear-related fields. At the time, relations between the U.S. and Libya were breaking down as Muammar Qaddafi came to power. Before the 1983 decision, the Reagan administration in 1981 also invalidated the use of U.S. passports for travel to Libya and banned the import of Libyan oil. Later in the decade, Libyans spearheaded the bombing of Pan Am Flight 103 over Lockerbie, Scotland, and also were involved in the bombing of a French airliner.
In 2011, Qaddafi was killed, and his government was replaced.
A DHS official told FoxNews.com on Monday that the department is now “reviewing U.S. policies that have been in place since before the Libyan revolution to see how they might be updated to better align with U.S. interests.”
Without commenting specifically on the draft proposal, the official said: “The United States supports the aspirations of the Libyan people as they participate in their democratic transition after 42 years of dictatorship. We are committed to working with Libya to build its sovereign institutions and are working closely with the government to bring stability to Libya.”
The official noted that the draft proposal is “deliberative and not final” and had “not been approved by DHS for publication.”
A copy of the document reviewed by FoxNews.com says that DHS is moving to rescind the restrictions “after consultation with the Department of State and the Department of Defense.”
The document notes that U.S.-Libya relations eroded beginning in the 1970s, leading to the nation being placed on the list of state sponsors of terrorism. It said the prohibition on Libyan nationals was imposed to deal with training “that could potentially have a negative impact on U.S. national security.”
But the document notes that Libya has moved to democratize since the fall of Qaddafi, and “most sanctions” that the United Nations and U.S. imposed have been lifted. It casts the effort to lift the travel restrictions in that light, noting the new Libyan government has “expressed initial interest” in sending students to the U.S. to receive training from the Defense Department to help them rebuild and sustain their own fleet.
“The United States has normalized relations with Libya and is working to establish robust diplomatic, military and economic ties,” the document says.
Chaffetz and Goodlatte, though, warn that the administration could “unilaterally” make these changes, and are urging the department to back down.
Chaffetz said that if necessary, the House could pass legislation barring the change, but he questioned whether the Senate would follow suit. Chaffetz said these changes have “not yet been earned.”
Across the nation, major insurance companies are severely slashing individual policies. In Florida, insurance carrier Florida Blue has sent out 300,000 cancellation notices — representing 80 percent of its individual coverage policies in the state. Kaiser Permanente of California canceled 160,000 plans — half of the company’s individual insurance plans in the state. In Pennsylvania, Insurance Highmark in Pittsburgh recently announced plans to cancel 20 percent of its individual plans, while Independence Blue Cross in Philadelphia announced the cancellation of 45 percent of its equivalent plans.
This comes at a time when the overall number of employer-based plans being offered is shrinking, according to the National Institute for Health Care Reform. Since 2007, the percentage of children and working-age adults in the United States with employer-sponsored health insurance dropped from 63.6 percent to 53.5 percent. Since 2010, the percentage has actually dropped at a sharper rate because of fallout from the Great Recession.
“This is just the beginning, however, of the Obamacare collapse in health insurance coverage,” writes Peter Ferrara of Forbes, who maintains that Obama owes an apology to Sen. Ted Cruz, the leading opponent of Obamacare. The Congressional Budget Office “estimates that as many as 20 million will lose their employer–provided health insurance under Obamacare. Former CBO Director Douglas Holtz-Eakin estimated in a study for the American Action Forum that the number will be 40 million.”
Many are being dropped from their current plans because of several factors tied to the Affordable Care Act, including regulations that individual policies cover a higher percentage of overall medical costs.
Avik Roy of the Manhattan Institute, a leading healthcare expert, recently estimated that, based on market data alone, Obamacare is increasing insurance premiums by 99 percent for men, and 62 percent for women. Another study, from the American Action Forum, calculated that the Obamacare increases for individual health insurance policies to be 193 percent for women on average, and 260 percent for men.
The increases largely are a result of the regulatory requirements of Obamacare, which touts “free” check-ups, “free” preventive care, “free” contraceptives, and prescription drugs, mental-health treatments, and maternity care, among others, Ferrara points out.
Blue Shield of California reportedly sent termination letters to 119,000 customers last month whose plans don’t meet the new federal mandates, prompted by a requirement from Covered California, the state’s new insurance exchange.

The Examiner reported that visitor logs show that “CGI Federal President Donna Ryan visited the White House six times prior to her company being selected to do the IT design work behind the high-profile website.”
“Two of the meetings attended by CGI executives were with Vivek Kundra, Obama’s chief information officer. Kundra was a key figure in Obama administration information technology initiatives across the government,” the paper reported.
In addition to the $88 million contract awarded to CGI Federal for the health-insurance exchange website, the company has received a total of $422 million in contracts related to Obamacare since the legislation was signed into law, according to Bloomberg News.
